Can Passengers Be Held Liable For A Car Accident?

Car accidents in Denver are a common occurrence. Typical causes of car accidents include drivers who speed or fail to obey other traffic laws, drivers who are impaired by alcohol or drugs, distracted drivers, and inclement weather.  However, no one ever really thinks about the car accident that’s caused by a vehicle’s passenger.  While it may be easier to prove that alcohol or texting played a role in an accident, there are many actions that a passenger may take that can cause or contribute to an accident, including:

  • Grabbing the steering wheel from the driver;
  • Attempting to jump out of a moving vehicle;
  • Spilling something, like hot coffee, on the driver;
  • Suddenly shouting or yelling at the driver;
  • Frightening the driver; or
  • Assaulting the driver or another passenger in the vehicle.

In Colorado, drivers have a duty to exercise reasonable care when operating a vehicle so as to avoid injuring anyone, including passengers.  Thus, it is important that you establish that a passenger acted negligently or recklessly and that those actions were a direct cause of the accident.  If you are able to prove that the passenger was negligent or reckless, the passenger may be held responsible for any injuries or fatalities that were a result of the accident.

If you find yourself in a situation where a passenger in your vehicle is causing a disturbance, and you feel that their actions are distracting and creating a dangerous situation, you must take extreme care to handle the situation appropriately.  Demand that they immediately stop what they are doing and if they fail to listen to you, try to safely pull over and stop the vehicle until you can resolve the situation.  If you cannot resolve the situation, either ask your passenger to leave your vehicle or in extreme cases, you may have to call law enforcement to intervene.  Dealing with the situation in this manner is preferable to getting into an accident where you can be held liable for any injuries or other damages that result.
